The objective reality of ideas play san important role in the cartesian system, for upon it rests the whole force of his demonstration of the existence of God. Ex hoc (idea entis summe perfecti) enim uno tot avis demonstrationis meae dependet. Not only does the demonstration of God’s existence take its point of departure from the objective reality of ideas, but it is an axiom that the knowledge which we have of all things, sensible and insensible, rests on the objective reality of our ideas and on the application to it of the causal axiom. Omnia enim diligentissime circumspexi, et nullum aliud argumentum potui hactenus reperire. Important as this position is in the cartesian system for the reason that the actual existence of beings other than the thinking substance can be demonstrated only by beginning with the objective reality of ideas, still this docritrine was the cause of surprise and of many objections from his contemporaries. Descartes admits that the author of the first set of objections puts in brief compass his own argument for proving the actual existence of God, and, having indicated his assent to that which he thinks is clearly enough demonstrated, comes to the crux of that which is difficult in the demonstration.

The philosophers of the middle Ages were profoundly interested in the metaphysical explanation of reality. None of them questioned the validity of human knowledge; they took for granted the intellect’s capacity to arrive at truth and to construct valid sciences. Problems raised by the medievals concerning human knowledge were those of the Universals, of it is not surprising to find St Thomas Aquinas treating the problem of knowledge under its metaphysical aspect. Many present-day thinkers claim that even within the metaphysical explanation of knowledge, the Scholastic speculations centred round the object and the objectivity of knowledge without giving importance to the knowing subject and the spiritual riches of subjectivity. The modern age is often called the age of the discovery of subjectivity, of the triumph of the thinking subject and his interiority over the anonymous, impersonal and exterior object.

Frequently the New Testament and documents of the Magisterium refer to the Beatific vision with the term Life everlasting – Vita Aeterna. This may at first seem somewhat strange, especially to the philosopher who considers naturally certain the human soul’s capacity for endless existence. How was a term which suggests so natural a meaning selected to designate the knowledge and love of the Father, who is inaccessible to man save through the Son’s revelation? Is this not a rather inept way to denote so supernatural an operation? Certainly the eternal life demonstrated by the light of reason involves no such transcendent perfection. This is not research on the history of a meaningless subtlety. Its rather an attempt to throw light on another aspect of man’s feeble but continuing efforts after revelation to understand in some way the mystery of his deification in the Vision of God. For the present question attempts were made over a period of four hundred years and form part of the theological heritage of the Church.

Les members des Institut séculiers s’interrogent souvent au sujet de la nature et de la portée de leurs engagements. Ce travail répondra à leur attente. La Constitution Apostolique “Provida Mater Ecclesia” reconnaissait officiellement l’existence des instituts séculiers et leur conférait un premier statut canonique par la Lex pucliaris qu’elle promilgait le 2 février 1947. Le Motu Proprio Primo Feliciter du 12 mars 1948, bientôt suivi de l’Instruction Cum Sanctissimus de la Sacée Congrégation des Religieux en date du 19 mars de la même année, venaient achee ce premier travail législtif. Ces documents étaient l’heureux aboutissement d’une longue evolution que consacraient ces actes de lìautorité supreme dans l’Eglise. La doctrine qu’ils élaboraient et les Instituts qu’ils approuvaient ont attire de plus en plus l’attention des fidèles et provoqué des etudes et des recherches nouvelles au sujet de la nature et de la position des trios états de perfection. De ce fait, la Constitution Apostolique  Provida Mater Ecclesia a été à l’origine d’une nouvelle vie dans l’Eglise et a fortement favorisé et favorisera sans doute dans l’avenir l’adaptation des Odres et Congréfations religieuses aux besoins des temps nouveaux.

 

 

The “sanatio in radice” before the Council of Trent

The first part of this work is an investigation into the history of marriage convalidations in general prior to the 14th century. Since a sanatio in radice is a form of convalidation, it is in the dispensing activity of popes, councils and bishops that we will find whatever evidence there is concerning the genesis and early evolution of the sanatio. The first chapter ends with a demonstration of the inaccuracy of the commonly accepted opinion today regarding the first example of a sanatio in radice. Next we will describe the elaboration of the theory of the sanatio as it appears in the writings of the classical canonists. We will show that this method of convalidating marriages answered a definitive need, namely the defence of the Holy See against charges of undue interference in temporal affairs in the legitimation ad temporalia of bastard children living outside the papal dominions. In the third chapter we will trace the reception this new theory met with in the writings of the post-classical canonists, until it became the common opinion of the authors. We will then turn to examine whatever evidence we have as to how often the popes actually granted sanationes in radice during the two centuries before the Council of Trent. Finally we will analyse the various elements that go to make up this extraordinary form of marriage convalidation as it was conceived by its author and by subsequent canonist.
